CASE STUDY Personal Injury I was retained by a Middlesex county law firm in New Jersey representing the plaintiff in a personal injury case. The plaintiff had worked all of his adult life as a manual laborer up until three years ago when he was injured in a motor vehicle accident. He required back surgery, including a laminectomy, and yet he was still suffering from chronic pain. After interviewing the plaintiff, reviewing the medical and neuropsychiatric reports, and taking into consideration his physical limitations and social security disability status, I was convinced that he was no longer capable of working as a manual laborer or in alternative occupations. Thus, I concluded that he was totally unemployable in today's competitive marketplace. Based on my report, the attorney successfully negotiated a large out-of-court settlement.
I recently testified as an employability expert in a PI case
in Middlesex Cty. My testimony proved to the jury that the plaintiff was no longer
employable and the jury awarded the plaintiff
$2.9 million.
