CASE STUDY Back Pay Issues After Reinstatement I was also retained by the State of New Jersey - Department of Corrections and Department of Human Services - to assist them in reducing back pay awards for employees who were terminated and later reinstated. Two cases were chosen to determine whether the plaintiffs had performed diligent job searches following their termination. Based on my reports which demonstrated that the plaintiffs had not conducted diligent job searches, the State was able to negotiate a settlement and ultimately reduced its claims by 50%, saving the Department of Corrections and the Department of Human Services, collectively, in excess of $100,000.
